# Soundportal — DMCA & Abuse Policy

## 🔴 BETA NOTICE

**Soundportal is beta software.** We're building responsibly but operating at startup speed. Expect:
- Security improvements over time
- Policy updates as we scale
- Response times may vary
- No SLA guarantee

## 1. Copyright Infringement / DMCA Claims

### You Own Content That's Being Misused
**If your track is submitted without permission:**

1. **Email us immediately:**
   - To: mickstots@gmail.com
   - Subject: "DMCA Claim - [Artist Name] - [Track Title]"
   - Include: proof of ownership (registration, metadata, rights documentation)

2. **What we'll do:**
   - ✅ Review within 48 hours
   - ✅ Remove content if valid
   - ✅ Notify submitter of removal
   - ✅ Investigate pattern (if repeated abuse)

3. **Counter-claim:**
   - If submitter believes removal was wrong, they can counter-claim
   - We'll re-evaluate and resolve within 72 hours

### You Submitted Content That's Actually Yours
- Keep proof: registration certificates, metadata
- Be honest about samples/features
- If challenged, respond within 48 hours with proof

## 2. Leaked / Unreleased Tracks

### A Track Was Leaked From Your Portal
**This is NOT automatically a copyright violation** (unless someone else owns rights), but we want to help:

1. **Email us:**
   - Subject: "Leaked Track - [Track Title]"
   - Explain: which portal, who had access, evidence of leak

2. **What we'll do:**
   - ✅ Check access logs (who viewed it, when)
   - ✅ Disable sharing/access for that track
   - ✅ Retain logs for 90 days
   - ✅ Notify relevant users if unauthorized

3. **Limitations:**
   - We're not responsible for track theft after leak
   - We can't guarantee no one copied the file
   - This is why private SoundCloud links are important

## 3. Content Moderation

### We Remove Content For:
- ✅ Copyright infringement (proven DMCA claim)
- ✅ Harassment or threats
- ✅ Spam or malicious links
- ✅ Illegal content (hate speech, etc.)
- ✅ Abuse of the platform

### We DON'T Remove Content For:
- ❌ Bad music (opinion, not our call)
- ❌ Competitive tracks (you don't like it)
- ❌ Disputes between producers/labels (civil matter)
- ❌ Personal drama (unrelated to copyright/abuse)

### Process
1. Report via email with evidence
2. We investigate within 48 hours
3. Decision: remove or keep
4. You can dispute (we'll reconsider)

## 4. Account Suspension / Termination

We may suspend or terminate your account for:

**Immediate (no warning):**
- ✅ Repeated copyright violations
- ✅ Hacking/unauthorized access attempts
- ✅ Harassment or threats toward others
- ✅ Selling/scraping data
- ✅ Illegal activity

**After warning:**
- ✅ Repeated minor violations
- ✅ Non-cooperation on DMCA investigations
- ✅ False/fraudulent DMCA claims

## 5. What You Must Do

### As a Label Owner
- ✅ Respond to DMCA claims within 48 hours
- ✅ Remove content if you can't verify rights
- ✅ Monitor your portal for unauthorized shares
- ✅ Tell submitters about copyright rules

### As a Producer/Submitter
- ✅ Only submit tracks you own
- ✅ Disclose samples/features if questioned
- ✅ Respond to rights inquiries quickly
- ✅ Don't re-upload after removal

## 6. Response Times (Beta)

**We aim for:**
- ✅ DMCA claims: 48 hours
- ✅ Abuse reports: 48-72 hours
- ✅ Counter-claims: 72 hours

**But:** Beta = sometimes slower. We'll notify you if delayed.

## 7. False Claims = Liability

**If you file false DMCA claims repeatedly:**
- We'll ban your account
- You may face legal liability (perjury)
- The law takes false DMCA claims seriously

- We handle claims **in good faith**
- But we're **beta**, not a massive platform
- We may make mistakes
- See Terms of Service for liability limits
